State withdraws charges against Sabaki MCA on ADC land

The state has withdrawn a case against Sabaki Member of County Assembly Edward Delle and 38 others arrested for allegedly invading the 900 acre ADC Kisiwani Complex farm in Magarini.

The MCA and the 38 squatters faced charges of incitement and preparation to commit a felony at the ADC land.

They were arrested on 16th October 2018 at Kwa Ndomo area a day after he led residents to invade the controversial ADC land.

They were arraigned in a Kilifi court where they denied charges against them and were released on bond.

The prosecution filed an application to withdraw the case citing lack of evidence. The court entered a Nolle prosequi and the accused were set free.

Kilifi county Assembly speaker Jimmy Kahindi who was the lead counsel in the case up lauded the decision said the case had been withdrawn because it lacked merit.

‘‘The prosecution after investigations found the charges malicious, I can say justice was done, the case had no merit,’’ he said.

The speaker said the case was interesting as the prosecution had difficulties in identifying the complainant and there was no property damaged.

‘‘They have done justice to Sabaki people, yesterday was a good day for the people of Sabaki they can now continue to enjoy their freedom,’’ he said.
